Fixing stage completed - 26 March 2015

We were aware that the Fixing stage was moving along at the same time as the Lock up stage was being completed. This meant that both of these stages were possibly going to be completed simultaneously.

Due to some of the comments from Construction Manager 'S' at our last meeting (see previous post) I was distrustful that the Fixing stage, in particular, would be complete prior to us being invoiced by Carlisle Homes. At the time, CM 'S' advised me to "just pay the invoice whether fixing is complete or not because it will get done"(To note: He also told me that the only person that could hold up hand over would be me if I complained about anything!!!). So, when we got our Fixing stage invoice one day after Lock up, I was not convinced that everything had been done according to our contract. As such, my son checked out the house that day and this is what we found:

The following items have not been completed in accordance to the contract definition of fixing stage:
·         Holes in plaster/walls – laundry & master (where meter box is),
·         Shelving in wardrobes, linen & pantry not present
·         Bath not present
·         Skirting not present in laundry


I emailed these concerns to the Team Leader 'D' at Head Office, quoting the definition of the Fixing stage completion as documented in our contract (see below).

The Construction Stages definitions are a part of the HIA contract. These are designed to protect the buyer, and ensure that builders are complying to regulations and expectations within the industry. However, even though Carlisle Homes use the HIA contract, there is also a disclaimer to this apparently (who knew??).

CONSTRUCTION STAGES (as per the Housing Industry Association) as listed in our contract:
Base Stage:
(a) in the case of a home with a timber floor, the stage when the concrete footings for the floor are poured and the base brickwork is built to floor level;
(b) in the case of a home with a timber floor with no base brickwork, the stage when the stumps, piers or columns are completed;
(c) in the case of a home with a suspended concrete slab floor, the stage when the concrete footings are poured;
(d) in the case of a home with a concrete floor, the stage when the floor is completed;
(e) in the case of a home for which the exterior walls and roof are constructed before the floor is constructed, the stage when the concrete footings are poured;
Frame Stage:
the stage when a home's frame is completed and approved by a building surveyor;
Lock up Stage:
the stage when a home's external wall cladding and roof covering is fixed, the flooring is laid and external doors and external windows are fixed (even if those doors or windows are only temporary);
Fixing Stage:
the stage when all internal cladding, architraves, skirting, doors, built-in shelves, baths, basins, troughs, sinks, cabinets and cupboards of a home are fitted and fixed in position;
Completion:
the Building Works are complete in accordance with the Contract Documents. 
NOTE: This table is prescribed by Section 40 of the Domestic Building Contract Act 1995. In the case of a Domestic Building Contract that is not listed in the Table, a Builder must no demand or receive any amount or installment that is not directly related to the progress of the Building Works being carried out under the Contract. 

The response to our email was surprising, as follows:

The definition of fixing stage that you are referring to on page 7 of 38 in the HIA contract is a generic definition.  Please note on page 9 of 38 in the contract additional information on this stage where it states what the fixing stage excludes: ‘As defined in section 40 (1) of the Domestic Building Contracts Act 1995 including garage, roof trusses on double storey homes but excluding: garage doors, baths or spas, built in shelves to robes, pantry and linen cupboards and, where contracted, Caesarstone, marble, granite or similar benchtops, feature sliding robe doors, feature pantry doors, sinks and basins’.


So, essentially there is a loophole in the contract (surprise, surprise!) that we were unaware of. I know that some of you are saying "Didn't you read your contract?" and the answer is yes, but obviously I was unable to remember or understand everything on those 200+ pages!

Carlisle Homes pride themselves on the fact that they use a Housing Industry Association (HIA) contract, as they are highly regarded. I feel that Carlisle Homes use the fact that they use a HIA contract to promote a feeling of integrity to their customers, however, upon closer inspection and experience, their disclaimers negate that in my opinion.

Anyway, I have now sent the invoice to the bank for payment. Our contract states that if we don't comply with our contract and pay the invoice within 14 days we will be charged interest on the outstanding amount.

When visiting the house today, I noticed that the cornices in the garage are also not complete - just saying!

Lock up Completed - 25 March 2015

So, things are moving along, with a few ups and down, as follows.....

Our new (2nd) Site Supervisor 'M' "no longer works for Carlisle Homes" and our new (2nd) Client Liaison Executive 'A' has also mysteriously disappeared with no explanation. I only found this out after trying to call her for 5 days and leaving messages without getting a response. I eventually requested to speak to her Supervisor 'D' who then advised me that 'A' will no longer be our CLE! Not feeling the love Carlisle! This translates to not feeling that our build is in safe hands at all. At this stage, our build is being 'overseen' by the Construction Manager 'S' (who I had a disappointing meeting with last week when I met 'M') and Team Leader 'D' at Head Office. The concern I have about this is 1. there is obviously some major staffing issues at Carlisle, 2. we haven't established any kind of rapport with these people, 3. we don't have dedicated people on our build, either on site or at head office, and, 4. both of these people have other responsibilities (managing other staff who manage hundreds of builds), which I fear will take precedence over our build. I feel that Carlisle Homes are not living up to their widely advertised claim that they are "No. 1 for Customer Service''!!!! Seriously, don't think so!

At last weeks meeting with SS 'M', Construction Manager 'S' also attended (I didn't know who he was at the time as he didn't introduce himself - he was just there). Whenever I asked 'M' a question, 'S' spoke over the top of him and answered everything on his behalf, unsatisfactorily in my opinion. In building a home, there are specific stages that occur along the way. These are dictated by an independent governing body and when each stage is completed, the client (us) is then invoiced a certain percentage of the total build cost (usually $40-$50k each stage). It is then our responsibility to authorise this invoice for the bank to pay. We have been told along the way not to pay an invoice until that stage is definitely complete. When I met with 'M' and 'S' last week, I asked when Lock up would be completed and was told by 'S' that we were "way past lock up''. I was aware that part of the Lock up stage included all brickwork to be completed, and to be standing next to our house with the brickwork clearly not complete and being told that we were "way past lock up" was a joke. Really? The condescending attitude that this information was delivered wasn't very 'customer' friendly, and this, along with his arrogance and rudeness made me feel distrustful of this man. I decided there and then that I wouldn't deal with him again. Now it seems I don't have a choice.

On Wed 25 Mar 2015 we received an invoice for Lock up completion. My son had been to the house a couple of days prior and saw that the brickwork at that stage was nearly done, so we paid the invoice.

More progress pics...

After a 'not so productive' meeting with the new SS this morning I took the opportunity to take a few measurements so that I can start thinking about (seriously) window coverings, particularly for the bathrooms. I also took the opportunity to take some more pics.

Progress since last visit - Cabinetry is in in kitchen & bathrooms, brickwork is nearly finished, however, they've run out of bricks and expecting another delivery on Monday. This will delay the 'Lock Up' stage for awhile and, as such, it may coincided with the completion of the 'Fixing' stage.

Re kitchen - on top of the cabinets is a 'template' for the ceasarstone benchtops which are expected to be installed in 2 weeks time.

In taking some window measurements it became apparent that a few of the measurements are a bit wonky ie. re the far left window in the master is 29cms from the wall at the top of the window and 31cms from the wall at the bottom of the window. Also noticed that the bathroom windows are about 3-4cms smaller than on the plans. Not sure if this is reasonable or not but may seek some advice on this. I haven't measured all the windows but may be a good idea to do so I think.
(Post dated note: My son checked the window measurements and they are ok. I measured them wrong! I blame it on my cheap & nasty measuring tape!!!!)

It is difficult when the people you have worked with and have been happy with move on. The fact that we don't know our new SS and CLE means that the whole process feels very impersonal now and I definitely feel they don't have our best interests at heart. In saying this, I think we might think about getting an independent inspection now so that we know that everything is ok. It's hard to trust people to do the right thing, particularly if you don't know them or vice versa.

New SS estimates that hand over is about 8 weeks away. That is a few weeks better than the last estimate!
